Welcome to Baby Photo Studio (the “App”). These Terms of Use (“Terms”) govern your access to and use of the Baby Photo Studio mobile application and related services (collectively, the “Service”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

## 1. Description of Service
Baby Photo Studio is an AI-powered image processing application that allows users to upload photos (primarily of babies/infants) and apply various AI-driven filters and transformations. The Service uses third-party AI models to generate stylized versions of uploaded images.
## 2. Eligibility
By using the Service, you represent and warrant that you are at least 18 years of age or the age of legal majority in your jurisdiction. If you are under the age of 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
## 3. User Accounts and Data
### 3.1. Anonymous Authentication
The App uses Firebase Anonymous Authentication to create a seamless experience. While you do not need to provide an email address initially, your account is tied to your specific device. If you delete the App or lose your device, your generation history and purchased coins/subscriptions may be lost unless otherwise linked to a permanent account.
### 3.2. Data Privacy
Your use of the Service is also governed by our [Privacy Policy]. We collect minimal data necessary for the operation of the AI generation service, including uploaded photos and generated results.We may use third-party service providers to process uploads and generate results. Retention periods and deletion options are described in our Privacy Policy, and you may request deletion as stated there.
## 4. User Content and AI Generation
### 4.1. License to User Content
You retain ownership of the photos you upload to the App (“User Content”). However, by uploading User Content, you grant Baby Photo Studio a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, and modify your User Content solely for the purpose of providing the AI generation service to you.
### 4.2. Rights to Generated Content
Subject to your compliance with these Terms, applicable law, and the terms of our third-party AI providers, as between you and Baby Photo Studio, you are granted a worldwide, non-exclusive, royalty-free right to use, download, and share the images generated by the Service (“Generated Content”) for personal and commercial use. We do not guarantee that Generated Content will be unique, and similar outputs may be generated for other users.
### 4.3. AI Accuracy and Nature
You acknowledge that:
– AI-generated content can be unpredictable and may occasionally produce results that are inaccurate, offensive, or inappropriate.
– The App does not guarantee any specific artistic result.
– “Baby” filters are intended for entertainment purposes and may not reflect actual appearances.
– The Service is for creative and entertainment purposes only and does not provide medical, safety, or identity verification advice.
## 5. Prohibited Conduct
You agree NOT to use the App to:
– Upload any content that depicts child sexual abuse material (CSAM), violence, nudity, or anything that violates local or international laws.
– Upload images of individuals without their express consent (or parental consent for minors).
– Attempt to reverse-engineer, decompile, or extract the source code of the App or the underlying AI models.
– Use the Service to generate deepfakes or misleading content intended to harm or deceive others.
## 6. Payments, Subscriptions, and Coins
### 6.1. Subscriptions
Some features of the App require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.You manage and cancel subscriptions through your Apple App Store or Google Play Store account settings. Where available, you may also use the “Restore Purchases” function in the App to restore eligible purchases.
Generation Limits. Depending on the subscription plan you purchase, your subscription may include a limited number of AI image generations during the applicable billing period (“Generation Limits”). The current limits are:
- Weekly plan: up to 25 image generations per week
- Yearly plan: up to 150 image generations per year
- Yearly Premium plan: up to 300 image generations per year
Generation Limits apply per account and reset at the start of each applicable billing period (weekly or yearly). Unused generations do not roll over to the next period.If you reach your Generation Limit, you may need to wait until the limit resets, or you may be able to purchase additional coins/credits (if available) or upgrade to another plan to generate additional images.We may change Generation Limits and plan features from time to time to the extent permitted by applicable law and store policies, and any changes will be reflected in the App and/or these Terms.
### 6.2. Coins and One-time Purchases
The App may offer “Coins” as a virtual currency for individual generations. Coins are consumed upon each successful generation request. If you reach your subscription Generation Limit, you may be able to purchase additional Coins (if available) to generate additional images without waiting for the limit to reset.
Coins have no cash value, are non-transferable, and do not constitute property. Coin availability, pricing, and the number of generations obtainable per Coin may vary by platform, region, and over time, and may be changed at any time to the extent permitted by applicable law and store policies. We may also modify or discontinue Coins (in whole or in part) as permitted by applicable law.
### 6.3. Refund Policy
All purchases are final and non-refundable, except where required by law. If a generation fails due to a technical error on our part, we may, at our discretion, refund the specific coins or generation credit used. Please contact support via the App settings for assistance.
## 7. Intellectual Property
The App’s interface, branding, logos, and underlying software are the exclusive property of Baby Photo Studio and its licensors. You may not use our branding or trademarks without prior written consent.
## 8. Disclaimers and Limitation of Liability
### 8.1. “As Is” Basis
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
### 8.2. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABY PHOTO STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
## 9. Termination
We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests. Upon termination or suspension due to a violation of these Terms, you may lose access to the Service and any unused subscription entitlements or Coins, to the extent permitted by applicable law.
## 10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Türkiye, without regard to its conflict of law principles.
## 11. Changes to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
